Migration and Fundamental Rights at the Southern Borders of the European Union

Mainly as a consequence of the “Arab spring”, almost every day media show us men, women and children board overcrowded and ill-equipped boats in an attempt to reach the South borders of the European Union. It is well known that rescue operations at high seas have been censored by the European Court of Human Rights in the case Hirsi 2012. Furthermore, more recently the media have brought to the attention of everyone the human rights violations in migrants reception centers in Lampedusa. Thus, the main objective of JM Module didactic activities is deepen knowledge and critical assessment of issues related to legal and illegal migration at the Southern border of EU, examining applicable “multilevel” rules and fundamental rights and the “conflicts” often existing between the different legal levels, as well as those between the National authorities’ practices and the European rules and principles. This is essential for post-graduate students (School of Specialization for Legal Professions; post-lauream Course in EU Law; Ph.D students), as well as for students who are entering the world of legal and administrative professions in the “South” Area of Freedom, Security and Justice and who daily deal with different issues related to both regular and irregular migrants, as well as asylum seekers. The related research activities will encourage academic debate and will promote run of the European values towards other educational institutions and civil society organizations (even through existing parnerships), especially of the South border of the EU. The intermediate and final outcomes (especially the final conference proceedings) will be published, disseminated and valorised by increasing the impact together with the transfer of expertise from the academic area towards the civil society, as well as the National and EU Institutions. Furthermore, all the activities will be disseminated through a dedicated website, even useful as a “research network” and “open learning” tool.
