While the Union is still facing the political consequences of the financial crisis, there are other important challenges for the European integration that have attracted the attention of some commentators over the last months. Circumstances like the problematic accession of the EU to the ECHR (after Opinion 2/13 of the Court of Justice of the EU), the difficulties connected to Art. 7 TEU and the debate about the possibility to set up a sort of Copenhagen Commission require a thoughtful reflection.This module will deal with these issues, trying to provide a critical and updated view on the most recent developments in the field of European Public Law.They are not only legal issues, they are much more, fundamental steps in the progressive democratization of the EU, understood as a community based on the respect of fundamental rights and rule of law. There will be 40 hours plus other activities aimed to focus on specific aspects or case studies. At the end of each year a workshop will be organized and students will be asked to present a paper on subjects related to those analysed in the course. Сourse attendance will be not less than 85%.Learning Outcomes• Understand the basic concepts of European Public Law• Have confidence in legal problem solving skills and concepts, including identifying and diagnosing a problem, finding precedents in the CJEU’s case law• Get used to the analysis of the text of judgements• Develop critical skills and ability to formulate relevant legal theories, generating alternative solutions and strategiesThe strong expertise and tradition we have in terms of research at the Scuola Sant'Anna could pave the way for the creation of a leading hub in European Public Law Studies in Pisa.
