Espace pénal européen: coopération judiciaire, garanties procédurales et lutte contre la criminalité transnationale

The project will create a new course dedicated to judicial cooperation in criminal matters in the EU. It will be organised in the form of an intensive course (the first in Italy on this subject) for one week per year. For the first year, the project will be devoted to the main aspects which characterise the field addressed by the Module; for the second year, the course will concentrate on the principle of mutual recognition in criminal matters, investigating its applications in EU law and in the Italian legal order; for the last year, attention will be drawn on the approximation of Member States’ criminal laws and on the establishment of a European Public Prosecutor’s Office. The Lisbon Treaty puts in place a closer integration between criminal judicial cooperation and free movement of persons in the EU, emphasising the need to intervene in criminal matters in order to ensure appropriate safety in the European common area and to protect individual rights. The aim of the course is to provide the recipients (mainly graduates, lawyers and judges) with such knowledge as is necessary for a proper application of the instruments of judicial cooperation, fostering reflections and stimulating the debate on a specific aspect of European integration. The lectures will be given by experts (professors and judges) in EU law and criminal law,as well as by judges and officials from Italian and EU institutions. The speakers (each one with his own cultural background and his theoretical or practical experience) will provide a complete and multidisciplinary framework of the subjects. The preparation of the participants will be tested by means of a written article about a specific case. The best articles will be published on the website http://www.eurojus.it. The research carried out will lead to publications on scientific journals and on an edited book.
